What Happens When an Heir Is Missing? (Real Case Study)

Some real estate deals close in a matter of days.

Others take nearly two years.

This was one of those deals.

We recently closed on a blighted property in New Orleans East, but what makes this deal unique isn’t just the condition of the house. It’s everything that had to happen behind the scenes to make the closing possible.

This deal took 21 months from contract to close.

You can watch the video to see the full story, or read the breakdown below.

A Complicated Inherited Property with Multiple Heirs

Like many distressed properties, this house had been sitting vacant for years.

It was an inherited property owned by multiple siblings, and as is often the case in Louisiana succession situations, things weren’t straightforward.

One of the heirs was missing.

The family believed he had passed away during Hurricane Katrina, but there was no official death certificate and without that, there was no clear way to move forward with the sale.

The Legal Challenges: Missing Heirs and Title Issues

Without proof of death, the title could not be cleared through traditional means.

Working with the team at Title Stream, we had to pursue a private partition through the courts, allowing the known heirs to move forward with the sale while accounting for the missing heir’s interest.

That process alone took months.

During that time, additional complications arose:

  • One of the heirs passed away, requiring a new succession process
  • That heir’s family had to be located (including out-of-state heirs in Texas)
  • Legal notices had to be published and approved through the court system

Each step added time, complexity, and coordination.

Unexpected Challenges Along the Way

Just as we were nearing the finish line, another obstacle came up.

One of the remaining heirs suffered a stroke and was in recovery.

To move forward, we arranged for a mobile notary to meet her during physical therapy, where she was able to review and sign the documents.

Moments like this highlight how real estate is often about more than just property, it’s about people, timing, and circumstances that are completely outside anyone’s control.

Why Most Buyers Walk Away from Deals Like This

Most investors would have walked away long before this point.

Deals with:

  • Multiple heirs
  • Missing parties
  • Court involvement
  • Title complications

…are often seen as too difficult or too time-consuming.

But these are exactly the types of situations we specialize in.

Bringing a Blighted Property Back to Life in New Orleans East

Beyond the complexity, this property was also blighted and sitting vacant, contributing to the challenges many neighborhoods face in New Orleans East.

By working through the legal and logistical hurdles, we were able to:

  • Help the family resolve a long-standing situation
  • Convert a burden into cash for the heirs
  • Take control of a distressed property and prepare it for renovation

Our goal is always the same: solve the problem and create a positive outcome for everyone involved.

The Importance of the Right Team

This deal would not have been possible without the right partners.

A huge thank you to Olivia Keen Byers and the team at Title Stream for navigating the legal complexities and seeing this through to closing.

In situations like this, having experienced professionals on the legal and title side is critical.
